INTRODUCTION

We, Tam Jai (Singapore) Pte. Ltd. (“we”, “us”, or “our”) respect your legal rights of privacy and are committed to protecting the Personal Data (as defined below) of our Customers’, Users’ and/or Job Applicants’ (as defined below, hereinafter referred to as “you” or “your”) in line with our obligations under the applicable privacy laws.

This Privacy Policy (the “Policy”) sets out the basis upon which we may collect, use, disclose or otherwise process your Personal Data generally, in accordance with the Personal Data Protection Act 2012 and Personal Data Protection (Do Not Call Registry) Regulations 2013 including relevant amendments (collectively, “PDPA”). This Policy applies to the Personal Data in our possession or under our control, including Personal Data in the possession of organisations which we have engaged to collect, use, disclose or process the Personal Data for our purposes.

By accessing our loyalty programme website (currently https://tamjaisamgor.eber.co/) and/or our corporate website (currently https://www.tjsamgor.com/sg/) and any of its subdomains and subpages (collectively the “Online Platform”) as we may update from time to time, and by the provision of your Personal Data as and when prompted by the Online Platform(s), you are deemed to agree to this Policy, accept and agree to be bound by the same. However, you understand that if you fail to provide certain information as required, you may not be able to access or use certain parts of the Online Platform, and certain features of the Online Platform may not function properly or be made available to you as intended.

SCOPE OF APPLICATION

The Policy applies to all of our Online Platform(s). However, it excludes websites that have their separate personal data/privacy policies and/or which do not incorporate this Policy. This Policy also does not apply to services offered by other companies or individuals, including sites that may be displayed to you in search results, sites that may include our content, or other sites linked from our Online Platform(s) (including but not limited to, say, third-party food delivery platforms featuring our restaurants). The Policy does not cover the practices of other companies and organizations in handling the information that they receive even if and when they advertise our services, and/or may use their own Cookies, pixel tags and other technologies to serve and offer the relevant advertisements. Accordingly, we assume no liability whatsoever and howsoever arising as a result of the above, in particular, without limitation, the collection and/or use of personal data by third parties which takes place outside of our Online Platform(s) and/or is outside the scope of this Policy.

PERSONAL DATA

  1. As used in this Policy:

    “Customer or User” means an individual who (a) has contacted us through any means to find out more about any goods or services we provide, or (b) may, or has, entered into a contract with us for the supply of any goods or services by us;

    “Job Applicant” means an individual who have applied for any position with us;

  2. “Personal Data” means data, whether true or not, about a Customer, a User or a Job Applicant who can be identified: (a) from that data; or (b) from that data and other information to which we have or are likely to have access.

  3. Depending on the nature of your interaction with us, some examples of Personal Data which we may collect from you include:

    • If you are a Customer or User: name, email address, telephone number, gender, and date of birth;
    • If you are a Job Applicant: name or alias, email address, telephone number, gender, date of birth, nationality, last four (4) characters of your NRIC/FIN or passport number, resume, educational qualifications, professional qualifications and certifications, employment and training history, employment references, and photographs.

    Other terms used in this Policy shall have the meanings given to them in the PDPA (where the context so permits).

COLLECTION, USE AND DISCLOSURE OF PERSONAL DATA

  1. We generally do not collect your Personal Data unless:

    • (a) it is provided to us voluntarily by you directly or via a third party (including your job placement agent if you are a Job Applicant) who has been duly authorised by you to disclose your Personal Data to us (your “Authorised Representative”) after: (i) you (or your Authorised Representative) have been notified of the purposes for which the data is collected, and (ii) you (or your Authorised Representative) have provided written consent to the collection and usage of your Personal Data for those purpose; or
    • (b) collection and use of Personal Data without consent is permitted or required by the PDPA or other laws. We shall seek your consent before collecting any additional Personal Data and before using your Personal Data for a purpose which has not been notified to you (except where such collection and/or use is permitted or authorised by law).
  2. Your Personal Data will be collected in two ways:

    1. Those Personal Data provided by you: when you register for an account and subsequently log in to your account on the Online Platform, or when you submit a job application on the Online Platform, or when you request for information and/or make inquiries, you will be asked to provide us with your Personal Data, including but not limited to your name and email address;

    2. Those Personal Data collected from your use of the Online Platform: we may collect information in respect of the pages on the Online Platform that you use and how you use them. Such information shall include but not limited to the following:

      • (i) Device information: we may collect device-specific information (such as hardware model and the operating system version);
      • (ii) Log information: when you view the contents on the Online Platform, we may collect and store certain information in the server logs. This may include:
        • details of how you viewed such content, such as search queries;
        • internet protocol address;
        • information concerning your device such as crashes, system activity/activities, hardware settings, type and language of your browser, the date and time of your request and the landing page path and/or the destination URL into or from the Online Platform;
        • Cookies (as defined below) that may uniquely identify your browser and/or your User account.
      • (iii) Location information: when you use the Online Platform, we may collect and process information about your location such as the country and/or the city you are located in while using the Online Platform.
      • (iv) Cookies and anonymous identifiers: Cookies are small files that are sent to your device when you visit a website to store your preferences as a User and related information with a view to analysing your web-surfing habits and preferences (collectively, the “Cookies”). The Cookies allow that website to recognize your browser in your subsequent visits and are commonly used to track your preferences in relation to the subject matter of the website.
  3. Your browsing and usage of the Online Platform may trigger our use of Cookies and/or anonymous identifiers to enable tighter security, to personalize the Online Platform for your use, to build your profile in your registered account, and to enable you to browse the Online Platform and to use certain of its features of the Online Platform based on your choices and information.

  4. You may reset your browser to disallow Cookies or to reject acceptance of Cookies when being alerted. However, by disabling Cookies, you may not be able to access or use certain parts of the Online Platform, and some of its features may not function properly or be made available to you.

  5. If you are a Customer or a User, we may collect and use your Personal Data for any or all of the following purposes:

    • (a) performing obligations in the course of or in connection with our provision of the goods and/or services requested by you;
    • (b) verifying your identity and updating your personal and contact information;
    • (c) responding to, handling, and processing queries, requests, applications, complaints, and feedback from you;
    • (d) managing your relationship with us;
    • (e) processing payment or credit transactions;
    • (f) improving and enhancing your experience on the Online Platform;
    • (g) customizing your profile;
    • (h) measuring and further developing the Online Platform and/or its content;
    • (i) conducting research and statistical analysis, notifying you of the redemption of gifts/coupons and relevant arrangements for the redemption;
    • (j) subject to your consent to undertake direct marketing activities, for instance, by providing you with our latest news update on our products, services, promotional events, or other marketing materials or information as and when sent out by us (whether directly or indirectly) through channels including but not limited to emails, SMS messages, and/or instant messaging applications (such as WhatsApp);
    • (k) complying with any applicable laws, regulations, codes of practice, guidelines, or rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority;
    • (l) any other purposes for which you have provided the information;
    • (m) transmitting to any unaffiliated third parties including our third-party service providers and agents, and relevant governmental and/or regulatory authorities, whether in Singapore or abroad, for the aforementioned purposes;
    • (n) any other purposes as specified at the time of collection of your Personal Data;
    • (o) any other incidental business purposes related to or in connection with the above.
  6. If you are a Job Applicant, we may collect and use your Personal Data for any or all of the following purposes:

    • (a) assessing and evaluating your suitability for employment in any current or prospective position with us;
    • (b) verifying your identity and the accuracy of your personal details and other information provided;
    • (c) for preliminary discussions on salary and/or other benefits;
    • (d) any other incidental business purposes related to or in connection with the above.
  7. We may disclose your Personal Data:

    • (a) where necessary to enforce the Terms of Use;
    • (b) on a need-to-know basis and subject to clause 24, to our parent company Tam Jai International Co. Limited and/or such of its subsidiaries within the same corporate group (whether located in Hong Kong or otherwise), for purposes stated in clause 8 and clause 9;
    • (c) where such disclosure is required for performing obligations in the course of or in connection with our provision of the goods and services requested by you;
    • (d) to third party service providers, agents and other organisations we have engaged to perform any of the functions with reference to the above mentioned purposes;
    • (e) if required by law or in the good faith belief that such action is necessary to: (i) conform to legal requirements or legal processes served on us or the Online Platform; (ii) protect and defend our rights or property; and (iii) protect the personal safety of Users of the Online Platform; and/or (iv) where your consent has been obtained for disclosure.
  8. Where your use of the Online Platform is concerned, you acknowledge and accept that certain functions, when activated or used by you, will operate to send or display information about yourself, including but not limited to, your Personal Data to certain third parties, and you agree to the sharing of such information with these third parties. You acknowledge and agree that we shall not be held responsible or accountable for any loss, injury or damage sustained by you for sharing the aforesaid information arising out of your activation or use of such features on the Online Platform.

WITHDRAWING YOUR CONSENT

  1. The consent that you provide for the collection, use and disclosure of your Personal Data will remain valid until such time it is being withdrawn by you in writing. You may withdraw consent and request us to stop collecting, using and/or disclosing your Personal Data for any or all of the purposes listed above by submitting your request in writing or via email to our Data Protection Officer at the contact details provided below.

  2. Upon receipt of your written request to withdraw your consent, we may require reasonable time (depending on the complexity of the request and its impact on our relationship with you) for your request to be processed and for us to notify you of the consequences of us acceding to the same, including any legal consequences which may affect your rights and liabilities to us. In general, we shall seek to process your request within ten (10) business days of receiving it.

  3. Whilst we respect your decision to withdraw your consent, please note that depending on the nature and scope of your request, we may not be in a position to continue providing our goods or services to you or process your job application (as the case may be) and we shall, in such circumstances, notify you before completing the processing of your request. Should you decide to cancel your withdrawal of consent, please inform us in writing in the manner described in clause 12 above.

  4. Please note that withdrawing consent does not affect our right to continue to collect, use and disclose Personal Data where such collection, use and disclose without consent is permitted or required under applicable laws.

ACCESS TO AND CORRECTION OF PERSONAL DATA

  1. If you wish to make (a) an access request for access to a copy of the Personal Data which we hold about you or information about the ways in which we use or disclose your Personal Data, or (b) a correction request to correct or update any of your Personal Data which we hold about you, you may submit your request in writing or via email to our Data Protection Officer at the contact details provided below.

  2. Please note that a reasonable fee may be charged for an access request. If so, we will inform you of the fee before processing your request.

  3. We will respond to your request as soon as reasonably practicable. In general, our response will be within thirty (30) days. Should we not be able to respond to your request within thirty (30) days after receiving your request, we will inform you in writing within thirty (30) days of the time by which we will be able to respond to your request. If we are unable to provide you with any Personal Data or to make a correction requested by you, we shall generally inform you of the reasons why we are unable to do so (except where we are not required to do so under the PDPA).

PROTECTION OF PERSONAL DATA

  1. To safeguard your Personal Data from unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks, we have introduced appropriate administrative, physical and technical measures.

  2. You should be aware, however, that no method of transmission over the internet or method of electronic storage is completely secure. While security cannot be guaranteed, we strive to protect the security of your information and are constantly reviewing and enhancing our information security measures.

ACCURACY OF PERSONAL DATA

  1. We generally rely on the Personal Data provided by you (or your Authorised Representative). In order to ensure that your Personal Data is current, complete and accurate, please update us if there are changes to your Personal Data by informing our Data Protection Officer in writing or via email at the contact details provided below.

RETENTION OF PERSONAL DATA

  1. We may retain your Personal Data for as long as it is necessary to fulfil the purpose for which it was collected, or as required or permitted by applicable laws.

  2. We will cease to retain your Personal Data, or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purpose for which the Personal Data was collected, and is no longer necessary for legal or business purposes.

TRANSFERS OF PERSONAL DATA OUTSIDE OF SINGAPORE

  1. Except as provided under clause 10(b), we generally do not transfer your Personal Data to countries outside of Singapore. However, if we do so, we will take steps to ensure that your Personal Data continues to receive a standard of protection that is at least comparable to that provided under the PDPA.

EFFECT OF POLICY AND CHANGES TO POLICY

  1. This Policy applies in conjunction with any other notices, contractual clauses and consent clauses that apply in relation to the collection, use and disclosure of your Personal Data by us.

  2. We may revise this Policy from time to time and any such revisions will be posted on the Online Platform. We will not send individual notices to you and we encourage you to keep yourself updated of the changes posted on the Online Platform. Your continued use of our services, or your continued employment and participation in our recruitment process (as the case may be) constitutes your acknowledgement and acceptance of such changes.

LANGUAGE

In case of any discrepancies and/or inconsistencies between this English version and the translated version(s) of this Policy, the English version shall prevail.
